This Privacy Policy ("Policy") is provided by Flip Side Restaurant and Café LLC, known by its brand name, VMeals (bearing Commercial Licence No. 855127, having its registered office at Shop 5, Oxford Tower, Business Bay, Dubai, United Arab Emirates ("Company", "we", "us", "our").

While availing our services, for the purpose of efficiently assisting you and for such other purposes as detailed in this Policy, we may collect and process certain personal information that we receive from you ("you" or "your"). This Policy shall govern the manner of collection of personal information, the reasons for such collection, storage and use of personal information, and your with respect to such personal information processed, collected or stored by us.

If you choose to use any of our services, then you agree to the collection and use of information in accordance with this Policy. The personal information that we collect is used for providing and improving our services. We shall not use or share your information with anyone except as described in this Policy.

We are the controller of personal data obtained via our website, meaning we are the organisation legally responsible for deciding how and for what purposes it is used.

Personally identifiable information, such as your name, date of birth, gender, and your contact information (such as your email address, physical address, contact numbers);
Personally identifiable information required by us to verify and authenticate your identity (e.g. passport details, statutorily issued identification numbers etc.), and information collected from publicly available resources to verify the same;
Any delivery addresses specified for your order or subscription plan;
Information pertaining to your diet preferences, health, allergies, any specific treatments that you may be undergoing / undergone, and any other physiological and health related information;
Transactional details such as bank account, card details or other financial information, as may be applicable in your engagement with us;
Device and location specific information (including your location, IP address, browser details, traffic data, location data), such as information from your visits to our website app (page interaction information, length of visits, etc.), or in relation to marketing emails we send to you;

When you choose parameters and avail services through the options provided in our website;

Client Relationship Management

We maintain a database and email list program of our client details, which is used to intimate and update our clients about any changes, additions, modifications etc. of our services, rates, promotions, offers, discounts, including any publications, newsletters, trends and events. Our email correspondences in this regard may contain tracking technologies in order to track subscriber activity relating to engagement, demographics and other data, and to build subscriber profiles. We use this as a means by which to undertake direct marketing.

You are entitled to cease receiving marketing materials from us at any time by changing your preferences for receiving our marketing emails and updates, including opting for unsubscribing by following the instructions specified in the marketing emails or via the websites.

Cookies

Cookies are files with a small amount of data that is commonly used as a unique identifier. These are sent to your browser from the website that you visit and are stored on your device's internal memory. We use cookies to improve our website and services.

Specifically, we use Google Analytics, and other similar products to track unique visitors to our website and app (storing a unique visitor ID, the date and time of first visit, the time their current visit started and the total number of visits they have made); to register session details (so as to attribute visit information, including conversions and transactions to a traffic source); and to register that a website visit has ended and the browser closed. Most internet browsers have a mechanism notifying you when you receive a new cookie, and telling you how to reject new cookies or disable cookies altogether (if you wish to do so).

We further use a custom coded tracking process /software on our meal plan customization page on the Website, to locate and track our clients. We may also avail segment services in future on our Website to profile our customers.You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use or access certain portions of the services offered by us.

Sharing your Personal Information

We may disclose your personal information to a third party, (i) for outsourcing one or more of our services; (ii) to verify, confirm or update information provided by you; (iii) to keep you notified of any events, and other information about our services, or (iv) for other purposes disclosed at or before the time the information is collected. We may also need to transfer your personal information to other group entities or to third parties, in the case of any business re-organisation, business acquisition or mergers undertaken by us.

We may provide services where you can upload content (e.g., pictures, videos, reviews, testimonials, audio files, etc.), and post comments or reviews on the website or on any of the social media handles of the Company. Such postings shall be governed by our Terms and Conditions. Any personal information you may submit, display, or publish in or through the website or on the Company's social media handles shall be publicly available and may be read, collected, used, and disclosed by others. We cannot control who reads your posts or comments or what other users may do with the information you may voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information.

We may also need to disclose certain personal information of yours to third parties as may be necessary to efficiently provide our services (including but not limited to our legal counsels, accountants, government or regulatory authorities, logistics and delivery agents, dieticians, nutritionists, professional indemnity insurers, tax authorities). Any such disclosure shall be only after procuring your consent, where we are required to do so by law, or where it is necessary for the purpose of or in connection with legal proceedings or in order to exercise or defend legal rights. We do not sell, rent, distribute, or otherwise make, personal information commercially available to any third party.

In addition, we may /make use of third party technology services including, amongst other things, cloud security systems. The use of these services may require your personal information to be held in the cloud on infrastructure managed by the relevant service provider.

How long we keep your Personal Information

We shall retain the personal information for such duration as it shall be required to provide our services to you, and thereafter for such duration required as per any legal, contractual or business purposes.

Your posting and sharing of personal information through the Website constitutes your acceptance of this risk, and you hereby agree to waive any claims that you may have against us and any right to seek legal relief from us due to any misuse of the personal information in the manner aforesaid.

These services do not address anyone under the age of 18. We do not knowingly collect personally identifiable information from children under 18. In the event that we discover that a child under 18 has provided us with personal information, we shall immediately delete such personal information from our servers. Governing Law

The Policy shall be governed in accordance with the federal laws of UAE.

Any dispute or difference whatsoever arising between you and us with respect to this Policy shall be conclusively settled by arbitration by a sole arbitrator in accordance with the relevant rules of the Dubai International Arbitration Centre (DIAC) as modified from time to time (which are deemed to be incorporated by reference into this clause), and the award made in pursuance thereof shall be binding on the parties involved. The language of arbitration shall be English, and the place of arbitration shall be Dubai International Financial Centre, UAE. The arbitration award shall be in lieu of any other remedy which might otherwise be available to the parties.

For disputed claims of less than five hundred thousand dirhams (AED 500,000), the parties may elect to have the disputed claim decided by the Small Claims Tribunal (SCT) located within the DIFC Courts, Dubai.
